2nd travel ban blocked

The federal judges are doubling down against the President:
The state of Hawaii says an imam from Honolulu has legal standing to assert the First Amendment claim of religious discrimination when challenging President Donald Trump's revised travel ban.

Hawaii's case for a temporary restraining order to block the ban is being heard Wednesday in federal court in Honolulu.

The judge told lawyers that he is more interested in constitutional claims and wanted to know who had such standing in the lawsuit.

Attorney Colleen Roh Sinzdak says a Muslim plaintiff in the lawsuit, Ismail Elshikh, has such standing to challenge the ban. Elshikh says the ban prevents his mother-in-law, who lives in Syria, from visiting family in Hawaii.

Sinzdak says Elshikh and all Muslim residents in Hawaii face higher hurdles in reuniting with family members because of their faith.

She says that harm applies to all residents, not just Muslims.

In the middle of reading Mugabe and the White Africans. One thing that stands out to me is that without the police & courts standing down, any chance of success for us whites is limited. Secondly, to echo your point that when whites become the minority the war has pretty much been lost. The problem now , with the whites , is that if you exclude the part of our demographic that is left leaning - we have already become the minority.
Its a mess and some days ( like today ) the pessimism is palpable.

Unfortunately, in this case it's not just that simple, given that the United States has been doing its best for some years now to destroy the home in question.

Being a full-blood Anglo-American whose ancestors helped to found this Republic, I'm totally in favor of keeping it American. But in honesty, few of these Muslim immigrants would be here if the U.S. had not been messing over their countries since the 1940s. As Ron Paul put it in 2007, "They're over here because we're over there." Truth is, they really are "refugees", and until the American people make their government quit messing in other countries' business, there's a certain justice in their coming here.

When the fighting begins, everyone, even the moderates, will have to pick a side, they'll choose the side that'll protect them: their racial brethren are the only option. Notice the timing on the Travel Ban? Gorusch will be seated on SCOTUS before it gets there. They were always going to lose outside of the 9th Circuit. This is mostly circus, but Trump also has them by the balls and any of the smarter Liberals have that figured out already.

If the 9th Circuit ends up being smarter, they'll kill it on Standing. They don't want this coming back. Trump has forced them to fight on ground that "winning" is to lose.

Worst case scenario is losing at the SCOTUS. SCOTUS has set itself up as a new government, Trump calls the Supreme's bluff. Hilarity and Civil War ensue.

Best case scenario is winning at SCOTUS on merit. Trump and all future Presidents are now affirmed in denying anyone entry into the USA for whatever reason deemed necessary.

"Best Case" is why they timed the new order the way they did. The 4 on the Liberal Left of the Court were going to kill the challenge on Standing. (Which none of the States actually have. Note this time it's a private citizen? They knew they would have lost that one and it would have forever screwed up Stats suing in certain situations.) With Gorsuch on the bench, they Left can't avoid the damage by killing it on Standing. Trump will win on the Merit of the Government's claim.

Expect the 9th Circuit to be a little calmer in the head this time. They don't want to lose on Merit, but I hope they we get to that point. The Trump Administration is operating on specifically enumerated Rights from the Constitution. This is an utterly cut & dry case.

When it gets to the courts it's a total crapshoot. There's no such thing as cut and dry anymore.

SCOTUS rewrote Obamacare, when Congress clearly said that States who do not found an exchange will not get federal subsidies. SCOTUS discovered that the 14th Amendment means anything they please, including forcing all States to issue marriage licenses to same-sex couples.

That, in particular, is so far afield of the spirit of Constitution that you've got to realize something here, and fast: the US Constitution is a DEAD LETTER. You cannot cling to the naive belief that anything written in it, or any legal precedent of long standing, means buttkiss.

It's good that Trump is taking to Andrew Jackson in that Jackson is one of the few presidents who ever stood up to judicial overreach. The courts will roll everybody if they are allowed to, and this one in particular is aching to.

Not really. The leftist and minorities power centers are located in major urban areas. Frankly it is trivial for a few dozen men who are motivated and educated to shutdown power, water and food delivery to major urban areas turning them into massive death traps.

If they then instigate conflicts between the city dwellers and law enforcement the cities are functionally death camps without access to food, water, medical care etc.

The alt-right is predominantly suburban and rural, an equivalent strike cannot be made on the suburban and rural populations.

There is a government "war game" of this scenario floating around the Web and it has the death tolls sky rocketing within a week.

If it comes to civil war the left is in a very precarious position due to being primarily urban and that the right is significantly more heavily armed.

The fact the USSC could usurp the powers of the Congress and President to decide immigration and enforcement policies indicates war is here already. The "elites" seceded long ago and the Constitution is for suckers. Again, Trump positioned himself well at the Hermitage today with the portrait of Jackson looming in the background. Only the intensity of his support and huge crowds have kept the Deep State from going full Grassy Knoll on him. They are afraid, and likely the USSC is afraid as well. Two morons with a Bushmaster managed to pretty effectively shut down a lot of the DC area for two weeks back in 2001. It doesn't take much, our cities are extremely vulnerable. Engineers are nice to have, but really it's more a of problem of will and ingenuity moreso than technical knowledge.

We have been very fortunate that the Islamic terrorists, so far, have been focused on maximizing the spectacle rather than inflicting real mass pain.

1. The Establishment Clause, like the rest of the Constitution, cannot affect non-citizens. This should be obvious as a matter of logic. It would make as much sense to invade Canada because Quebec doesn't acknowledge the Mexican Constitution - or the refusal of Saudi Arabia to accept Jews on religious grounds becoming a Constitutional issue. It simply cannot (unless one decides that the US Constitution holds sway over the whole of the world - I doubt China will accept that answer).
2. The refuseniks. This one is straightforward. I have relatives who entered the country under this ruling; they were allowed in specifically because they were Jewish. Flat discrimination on the basis of religion.
3. The Establishment Clause itself only comes into effect on a federal level for existing citizens. By this I mean that it does not affect states - North Carolina, for example, required that elected state officials were Christian until the 1960s. Pennsylvania and New Hampshire were two of many states that had established state religions long after the adoption of the Constitution by their constituents. The reason is simply that it only has bearing on the federal level.

Of course. Only reason I mention and engineer is because they would likely have an understanding of most types of infrastructure. Even if you are an electrical engineer working for the power industry, half of your job is really as a civil engineer. Linemen would understand it as well, but as long as someone even understands the function of a pole mounted transformer, a couple of bad guys could cause a lot of outages in a single night for just a couple of dollars.

You are absolutely correct about it being security through obscurity. Rail, roads, bridges, water transport, power distribution, even fuel storage and the like are all very vulnerable and can be damaged for surprisingly little cost. We're lucky no one has been serious about doing so.

Only those nations that hate America as constituted count as new states. It's probably only about 190 stars.

Once the president refuses to acknowledge the court there is nothing they can do. Congress could hypothetically take action against the president but the court cant do much more than stomp their feet.

There is sufficient information out to understand that the GOPe/Uniparty is planning to impeach Trump and install Pence. Trump refusing to acknowledge the court without preparing for the impeachment would be fatal. He has to make it known he has the generals and the bayonets behind him at the same time he tells the rogue judiciary to shove it.

@140 The Supremes normally include language about the US Marshall service executing their actions (thus the George Wallace picture), but it's only a request. They actually lack the authority to do it.

But the really important part is that SCOTUS sits in DC. They're the most Politically Attuned of the Courts. Plus, they're very expansive in their Presidential Power jurisprudence, which they simply can't go against for this case. This is about the worst case possible for SCOTUS to actually go against the President.

Just think of the Optics. SCOTUS upholds the TRO. First terrorist attack from someone of that country? Trump can, quite rightly, blame every Judge that blocked the Order for the damages/deaths. SCOTUS will be really attuned to that reality. That's why this has all been an effort in Virtue Signaling. They're hoping to get away with their actions "scot-free", but don't expect Trump to let that happen. Oh, no, he's going to put the screws into them.

Then he's going to all but shut down immigration from any Muslim country.

Simultaneously Ive been reading the memoirs of a colonist wife who was captured by the Indians during King Phillips War- and lived to record it.
One of the reasons (not the only one) the US didn’t go the way of Africa is that the early colonists were consistent and methodical about fully eliminating every Indian village they encountered...that included elderly, women and children. They went full Cromwell on them. The colonists were so brutal the Naragansett Tribe ( who started out impartial to either side) were so shaken they ended up taking up arms with their formal rival tribes in an ill fated attempt at survival.
The original Scotch and British who came to Africa ( many in the late 1700s) were way too nice and respectful and it cost them dearly in the long run.

@83. Tyrone, you've got that backward. Most of us don't exactly see blacksmiths often any more, but anyone who has will immediately tell you that a single anvil will see the breaking of tens or hundreds of hammers.

This is one of those idioms that somehow got reversed by people that didn't know what they were talking about. Sure, the hammer strikes the anvil, but the hammer is also the object that breaks.

The left has been hammering away for the best part of a century, at least.

The anvil is still being cast, and may it break a billion hammers.

Fuck that. If it was about morals, the elites would avoid it like the plague. You don't see a lot of Rhodesians being shown sympathy by the press! If they really want the help, the real solution is for us to send our elites to the hellholes they've created. Syrians get actual justice, the bullshit wars stop, and we're rid of the parasites. And if they don't kill them, then we'll know they weren't such innocent victims after all.
